Terms and Conditions – SwiftOn.io
Effective Date: 9 June 2025 | Last Updated: 9 June 2025 These Terms and Conditions (“Agreement”) govern your access to and use of the software components, libraries, code assets, design elements, documentation, and related deliverables (“Components”) provided by SwiftOn.io, operated by SwiftOn Technologies (“SwiftOn”, “we”, “us”, or “our”). By purchasing, downloading, accessing, or using any Component from SwiftOn.io (the “Service”), you agree to be bound by the following terms and conditions. If you do not agree to these terms, you must not use our Service.
1. License Grant
Subject to your full compliance with this Agreement and timely payment of applicable fees, SwiftOn.io grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Components solely as part of native or hybrid iOS applications developed by you or your direct clients, for deployment in commercial or personal projects. This license is granted solely for integration purposes within proprietary applications and does not convey any right to distribute the Components as standalone files, modules, or libraries in any format or through any medium.
2. Prohibited Uses
You expressly agree not to, directly or indirectly: - Resell, sublicense, distribute, or otherwise make available any Component, in original or modified form, as a standalone product or bundled asset, whether for commercial or non-commercial purposes; - Include any Component in UI kits, design systems, component libraries, SDKs, frameworks, or app builders offered for public sale, distribution, or access; - Replicate, imitate, or reproduce the structure, design, or organization of SwiftOn.io’s offering as a competing product or service; - Use the Components in the creation of platforms, marketplaces, SaaS solutions, or no-code/low-code tools where the Components are accessible or downloadable by end-users; - Share or distribute Components with freelancers, contractors, or third parties except where necessary for the direct development of your licensed application, under strict confidentiality.
3. Ownership and Intellectual Property
All intellectual property rights in and to the Components, including copyrights, trademarks, trade secrets, and moral rights, remain the sole and exclusive property of SwiftOn Technologies. You acknowledge that the Components are licensed, not sold, and you shall not claim ownership or authorship of the Components or any derivative work that retains substantial similarity to the original assets. Any unauthorized use, reproduction, or distribution of the Components constitutes a material breach of this Agreement and may result in civil and/or criminal liability.
4. Subscription Plans and Payment
SwiftOn.io offers access to its Components via recurring monthly and annual subscription models. The details are as follows: - Automatic Renewal: You authorize SwiftOn.io to charge your selected payment method at the beginning of each billing period unless you cancel your subscription. - Pricing: Prices are subject to change at SwiftOn.io’s discretion, with changes communicated in advance and effective in the next billing cycle. - Cancellation Policy: You may cancel your subscription at any time from your account dashboard. Access to the Components will continue until the end of the current billing period. No refunds or credits shall be issued for partial periods or unused access unless required by law.
5. Account Obligations
You are responsible for maintaining the confidentiality and security of your account credentials. You agree to: - Not share your account with other individuals or entities; - Notify us immediately of any unauthorized use of your account; - Use the Service in accordance with all applicable local, national, and international laws and regulations. SwiftOn.io reserves the right to suspend or terminate access for any violation of this Agreement.
6. Termination of Access
SwiftOn.io reserves the right to suspend, revoke, or permanently terminate your license and access to the Service, with or without notice, for conduct that constitutes: - A material breach of these Terms; - Any unauthorized redistribution or resale of Components; - Abuse or misuse of the platform, including excessive downloads or scraping behavior; - Any action that harms the reputation, integrity, or functionality of SwiftOn.io. Upon termination, you must immediately cease all use of the Components and delete all local copies in your possession, whether modified or not.
7. No Warranty
The Components and Services are provided on an “as-is” and “as-available” basis. SwiftOn.io makes no warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement, except as expressly provided under applicable law. You agree that your use of the Service is at your sole risk.
8. Limitation of Liability
To the fullest extent permitted by applicable law, SwiftOn.io shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from or related to: - Use of or inability to use the Components; - Unauthorized access to your account; - Modifications or removal of Components from the platform.
9. Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising out of or relating to this Agreement shall be resolved exclusively through binding arbitration administered by the American Arbitration Association. The venue for arbitration shall be Wilmington, Delaware. You agree to waive any right to a jury trial or to participate in a class action lawsuit.
10. Changes to These Terms
SwiftOn.io reserves the right to revise these Terms at any time. Updates will be published on the website and take effect immediately upon posting. Continued use of the Service after changes have been made constitutes your acceptance of the revised Terms.
